Environment Conservation Act, 2002

Sec.6. Prohibition on production, sale, distribution of any commodities
/product which is harmful for environment---
The Government after consultation with the Director General of the
Department of Environment or otherwise if satisfied that all or any kind of
polythene shopping bag or any product made of polypropylene or polyethylene
which is harmful for environment may by notification in the official gazette
ban the production, marketing, sale, exhibition for sale, hold in stock for
sale, distribution, transportation for commercial purpose or for commercial
use of those all over the country or in any specific area or according to
any specified provision of the said notification issue an order for
direction or management of such act / program and all person shall be bound
to comply with such order.
Provided that, the order would not be applicable in respect of following
cases:
a) if the product mentioned in the said notice is exported or used for the
purpose of export
b) If it is stated in the said notice that the order would not be applicable
to a certain kind of polythene shopping bag.
Explanation: In this section "Polythene shopping bag" means any kind of bag,
packet, or container which is made of polyethylene, polypropylene or their
compound or mixture and which can be used for the purpose of shopping or
carrying or containing any thing.
Sec7. Substitution of section 15 of Act No. 1 of 1995 -- Sec. 15 of the said
Act would be substituted by the section 15 and 15 (a) described below.
" 15. Punishment -1) For disobeying the provisions mentioned in the
following table, or disobeying any order mentioned there on or for any other
acts, the punishment described against them would be applicable.
